Resumen: El propósito del texto es analizar la relación entre cuidado de sí e innovación educativa, considerando que el diálogo y la ironía, son prácticas que posibilitan que el cuidado de sí surja como novedad en la vida del sujeto. Para alcanzar dicho propósito, el texto está dividido en dos apartados, en el primero se revisan las nociones de cuidado de sí e innovación educativa, en el segundo se analizan el diálogo y la ironía. Se acepta que la innovación educativa (...) es esa posibilidad de mantener en novedad el cuidado de sí como transformación de sí. Se asume que diálogo e ironía son experiencia radical en una continua exigencia de reflexión como una manera de habitar la extrañeza y, simultáneamente, bajo el ejercicio pedagógico del ser y hacer de las prácticas educativas. Finalmente se considera al cuidado de sí e innovación educativa como: reflexión y vida en ejercicio. Asumimos que en el diálogo y en la ironía hay un doblez y giro de la atención, la inquietud y el cuidado de sí que lo hacen emerger como innovación educativa. A patent is a property granted to any new shape, configuration or arrangement of elements, of any device, tool, instrument, mechanism or other object or part thereof, that allows for a better or different operation, use or manufacture of the object that incorporates it or that provides it with some utility, advantage or technical effect that it did not have before. As a document, a patent really is a title that recognizes the right to exploit the patented invention exclusively, preventing (...) others from making, selling or using it without the consent of the owner. The fact of making a patent is motivated by the fact of promoting creativity, hindering competition in the market as only one person holds the patent, thus protecting the initial investment and fighting against plagiarism. Patents are available to the public for dissemination and general knowledge. It is generally recognized in the specialized literature that patents can be used as an indicator to calculate the results generated by research and development activities, being a very useful indicator to measure various social, economic or technological aspects. For this reason, it is of relevant interest to have tools or systems that allow us to obtain the patents developed in a specific period of time and to carry out analyses of various economic and social factors. These analyses can serve to obtain a social perspective of society’s progress in the technological field, and this is why an analysis of patents is of our interest. This paper proposes a platform specifically designed to obtain knowledge about patents as an indicator of Spanish social, economic or technological aspects. For this purpose, the platform retrieves, analyses and visualizes functionalities that represent data on the landscape of patents obtained from the Spanish Patent and Trademark Office as a particular case of study. Informed consent forms have been useful in clinical practice and they constitute a part of the shared decision making in the informed consent process. They provide information to patients about clinical procedures and techniques. They also act as a remainder of the information discussed after the medical interview. Sometimes these documents are not readable to everybody. Belgian law specifies that all information that patients receive has to be proportionate verbally, but written information is also handled. The present research analyzes the (...) readability of the Flemish informed consent forms located in the webs of all General Hospitals using a simple random sample of 75 informed consent forms. By using the Douma tool, which bases its analysis in the length of words and sentences, the readability mean of the sample was 46, level “Difficult”. The 59% of them had a difficult level. The 11% were normal. It is a fact, then, that the 59% of the informed consent forms evaluated in this study are not suitable for everybody in Flanders, especially those people with low literacy. There were some researches made in other countries that agreed with these results. Written clinical information was poorly written so the informed consent forms were not working helping patients to recall information nor helping patients to become a part in the shared decision making about their health. The use of readability formulas represented a simple way to discriminate those informed consent forms that had normal readability scores from those that should be adapted. (shrink)

Latin America is one of the most unequal continents in the world. This inequality translates into marked limitations in the possibilities of having a decent life for a high percentage of the population. Within the groups that are affected, women are undoubtedly even more so, because, in addition to shared economic and social inequalities with other vulnerable groups, they face discrimination based on gender. In Latin America, political protest has been undertaken by women who wish to denounce and abate the (...) injustices of which they are victims. These struggles have been analyzed by different thinkers. For the most part, feminist theories deal with the struggle of women against the oppressive behavior of patriarchy from the State or society. Others highlight the ability of women to contribute to social changes from socially accepted roles such as mothers, daughters, wives. These approaches ignore the difficulties experienced by female activists within the political mobilization. In this essay then we seek to document, analyze, and theorize about the patriarchal practices suffered by women activists - qua women- within the social organizations in Ciudad Juárez, as well as the forms of resistance they have opposed. La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. El sistema penitenciario de Ecuador enfrenta una crisis estructural de proporciones preocupantes. Esta investigación se centra en analizar las diversas causas que han precipitado esta situación, con el objetivo de determinar la responsabilidad del Estado ecuatoriano en esta crisis. Se examina específicamente si el Estado cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad tras el cumplimiento de sus penas. Se evidencia una ausencia significativa de programas efectivos de reinserción para las Personas Privadas de (...) Libertad (PPL), lo que directamente contribuye a la crisis carcelaria actúa. El propósito de este estudio es analizar críticamente la situación del sistema penitenciario ecuatoriano, identificando las deficiencias en los programas de rehabilitación y reinserción social ofrecidos a las PPL. Se busca determinar si el Estado es el principal responsable de la crisis carcelaria mediante el análisis de diversas fuentes bibliográficas y la evaluación de su cumplimiento de las obligaciones legales y humanitarias hacia este grupo vulnerable. Se llevó a cabo una investigación cualitativa, donde se analizaron diversas fuentes bibliográficas especializadas para abordar el problema del sistema penitenciario en Ecuador. Se examinaron informes gubernamentales, estudios académicos y documentos legales pertinentes para comprender a fondo las causas subyacentes de la crisis carcelaria. Esta metodología permitió una evaluación exhaustiva de las deficiencias institucionales y la falta de programas de rehabilitación adecuados para las PPL en el país. Los resultados de la investigación revelan una serie de factores que contribuyen a la crisis carcelaria en Ecuador. Entre ellos se destacan el hacinamiento, la sobrepoblación, el debilitamiento institucional, el tráfico de drogas y armas, entre otros. Se evidencia que el Estado no cumple adecuadamente con su obligación de rehabilitar a los condenados y reintegrarlos a la sociedad, lo que agrava la situación y hace más miserable la vida de las PPL dentro de los centros de reclusión. Este estudio confirma que el Estado ecuatoriano es el principal responsable de la crisis carcelaria existente en el país. La falta de programas efectivos de rehabilitación y reinserción social para las PPL, junto con otras deficiencias institucionales, ha exacerbado la situación. Es imperativo que el Estado tome medidas urgentes y efectivas para abordar estas deficiencias y garantizar el respeto de los derechos humanos y la dignidad de las personas privadas de libertad en Ecuador. IntroductionThis study aimed to evaluate, in adults with mild cognitive impairment, the brain atrophy that may distinguish between three AT biomarker-based profiles, and to determine its clinical value.MethodsStructural MRI was employed to evaluate the volume and cortical thickness differences in MCI patients with different AT profiles, namely, A−T−−: normal AD biomarkers; A+T−−: AD pathologic change; and A+T++: prodromal AD. Sensitivity and specificity of these changes were also estimated.ResultsAn initial atrophy in medial temporal lobe areas was found in the A+T−− and (...) A+T++ groups, spreading toward the parietal and frontal regions in A+T++ patients. These structural changes allowed distinguishing AT profiles within the AD continuum; however, the profiles and their pattern of neurodegeneration were unsuccessful to determine the current clinical status.ConclusionsMRI is useful in the determination of the specific brain structural changes of AT profiles along the AD continuum, allowing differentiation between MCI adults with or without pathological AD biomarkers. The papers in Richard Vallée's Words and Contents span twenty-one years. The author navigates the discovery and exploration of different expressions and perspectives on language in this volume. Beginning with referring expressions and later addressing context sensitivity, the book examines how specific words contribute to the contents of utterances and the philosophical issues that surround them.

Based on a framework that integrates job demands-resources theory, social cognitive theory Handbook of personality, Guilford Press, New York, pp 154–196, 1999) and regulatory focus theory, the purpose of this research is to investigate the relationship between perceptions of organizational politics and subsequent moral disengagement and unethical behavior. We conducted a laboratory study and also collected data in two separate surveys 6 weeks apart from 206 individuals working full time to investigate the relationships presented in our model. In both studies, (...) we examined the direct relationship of politics perceptions on unethical behavior in organizations as well as the indirect relationship through the influence of moral disengagement. We investigated the moderating effect of regulatory focus on the relationship between moral disengagement and unethical behavior using the survey data. Results indicated that perceptions of politics were significantly related to our mediator, moral disengagement, which was significantly related to our dependent variable, unethical behavior. However, only prevention-focus moderated the relationships examined. Implications for future research and managerial practice are discussed. (shrink)

Aggregating snippets from the semantic memories of many individuals may not yield a good map of an individual’s semantic memory. The authors analyze the structure of semantic networks that they sampled from individuals through a new snowball sampling paradigm during approximately 6 weeks of 1-hr daily sessions. The semantic networks of individuals have a small-world structure with short distances between words and high clustering. The distribution of links follows a power law truncated by an exponential cutoff, meaning that most words (...) are poorly connected and a minority of words has a high, although bounded, number of connections. Existing aggregate networks mirror the individual link distributions, and so they are not scale-free, as has been previously assumed; still, there are properties of individual structure that the aggregate networks do not reflect. A simulation of the new sampling process suggests that it can uncover the true structure of an individual’s semantic memory. (shrink)

Introduction: The use of human samples in genomic research has increased ethical debate about informed consent (IC) requirements and the information that subjects should receive regarding the results of the research. However, there are no quantitative data regarding researchers’ attitudes about these issues. Methods: We present the results of a survey of 104 US and 100 Spanish researchers who had published genomic epidemiology studies in 61 journals during 2006. Results: Researchers preferred a broader IC than the IC they had actually (...) obtained in their published papers. US authors were more likely than their Spanish colleagues to support obtaining a broad IC, covering either any future research project or any projects related to a group of diseases (67.6% vs 43%; adjusted OR = 4.84, 95% CI, 2.32 to 10.12). A slight majority of researchers (55.8%) supported informing participants about individual genomic results only if the reliability and clinical validity of the information had been established. Men were more likely than women to believe that patients should be informed of research results even if these conditions were not met (adjusted OR = 2.89, 95% CI = 1.46 to 5.72). Conclusions: This study provides evidence of a wide range of views among scientists regarding some controversial ethical issues related to genomic research, suggesting the need for more study, debate and education. In the interim, journals might consider including the investigators’ policies regarding these ethical issues in the papers they publish in the field of genomic epidemiology. (shrink)

Filozofia pamięci jest gorącym tematem w kognitywistyce i filozofii umysłu. Niniejsza praca analizuje spór między symulacjami a przyczynową teorią pamięci poprzez badanie poczucia swojskości i jego związku ze śladami pamięciowymi, a dokładniej w jaki sposób zwiększają one płynność rekonstrukcji przeszłych epizodów. Zrozumienie relacji między śladami swojskości i pamięci, a ponadto relacji między pełnoprawną fenomenologią pamięci a poczuciem subiektywnej pewności epizodu, jaki miał miejsce w przeszłości, prowadzi do odmiennej interpretacji rywalizacji między tym, co przyczynowe, a tym, co symulacyjne.

The International Criminal Court (ICC) is responsible for prosecuting individuals for heinous crimes that take place during civil and/or international armed conflicts, including sexual violence. Prosecuting this crime relies primarily on survivor accounts, but witnesses often fear the psychological effects of giving such testimony, particularly because there is a high risk of retraumatization, a stigma associated with victimhood, and a fear of victim-blaming. Thus, the Court’s Victims and Witness Unit (VWU) puts forth provisions for questioning vulnerable witnesses, requiring, in part, (...) that questioners avoid embarrassing or offending witnesses. Using a discourse analytic approach, this paper examines transcripts from three recent ICC cases dealing with wartime sexual violence—_Bemba, Ongwen_, and _Katanga and Chui—_exploring the discursive strategies employed by prosecutors and defense attorneys in these trials as they navigate arguing their cases before the judges while also tailoring their questions to adhere to the VWU’s provisions. I show that adhering to the provisions often involves relying on euphemistic expressions to discuss rape—which enter the trial discourse through linguistic formulations and reformulations—even though these expressions reflect the language used to discuss consensual sex and not sexual violence. Thus, this method of adhering to the provisions can undermine the prosecution’s case while helping the defense’s. (shrink)

This paper considers the UN efforts to introduce a legally binding Treaty on corporate accountability for human rights impacts in the context of other proposed legislation at country level, on the one hand, and existing voluntary initiatives like the UN Guiding Principles (2011), on the other. What we are interested in is whether the proposed Treaty signals a transition from voluntary initiatives (based on moral commitments) to law (that is, a focus on compliance), and the extent to which it might (...) stimulate or hinder links between judicial and non-judicial initiatives. The scholars who have explicitly addressed these two divides are – Michael Sandel, on theory v. practice; and Amartya Sen, on law v. morality. We engage with their views, in sections II and III respectively, seeking to build an integrated approach to help us overcome these dualisms. We further consider John Ruggie’s “principled pragmatism”, a strategy that he uses to build the Protect, Respect and Remedy (henceforth, PRR) Framework; and we invoke arguments from casuistry as well as a practice-focused deontology (Thomas Donaldson’s) in favour of an ethics ‘beyond cognition’, which we consider better suited than either utilitarian or principle-based theories to guide the debate on human rights. This is because it allows us to take non-rational factors into account (such as emotions and personal affiliations), when judging the kind of common good we consider worth pursuing. In the last section of the paper, we investigate whether and how might the Treaty illustrate the two divides, trying to (a) distinguish between purely legal elements and those of a wider nature, to do with morality; and (b) understand what might help bridge the gap between theoretical commitments to the universality of human rights and various practical challenges. Our aim is not to evaluate the Treaty, from a legal viewpoint, or suggest improvements to it (lawyers are better placed to do that); rather, we seek to investigate the way in which the proposed Treaty – which is the first attempt to address the challenge of transnational business and human rights in international law – combines moral and legal aspects, and what this tells us about the world we live in. In The Laboratory of the Mind, James Brown considers some of the Kuhn’s thesis in “A Function for Thought Experiment”. I will question one of Brown’s conclusions, namely his interpretation according to which Kuhn maintains that from thought experiments we learn about our conceptual scheme and only derivatively about the world. I arn inclined to think that this particular interpretation does not accurately represent Kuhn’s wording. Accordingly, I will outline some of the issues concerning the relation between ‘learning about the (...) concepts’ and ‘learning about the world’, which is, as Brown states, the field of disagreement between him and Kuhn. And finally, I will consider whether Kuhn’s ‘incommensurability thesis’ is in contradiction with ‘thought experiment thesis’, as Brown seems to imply. (shrink)

El presente artículo pretende describir el ethos, es decir, el hábito y la morada del historiador del arte, a partir de los elementos que vertebraron a la Historia Social del Arte: la reivindicación de los hechos, la consideración de las obras como el depósito de un intercambio social y la voluntad de ceñirse a los límites de lo históricamente descriptible. Distinguiéndose tanto de las preocupaciones específicas de la estética filosófica como de la reivindicación del pathos anacrónico propia de los recientes (...) programas de antropología de las imágenes, dicha historiografía, que en la generación de Haskell o Baxandall estuvo atravesada por un escepticismo general en relación con la teoría, se postulará, con la llegada de la New Art History, menos como un método que como el terreno sobre el que habría de lanzarse toda pregunta o todo concepto importado de la filosofía. Este trabalho tem como principal foco de análise o currículo oficial português relacionado com a componente de História, para o Ensino Básico, em particular as ausências que aí mais sobressaem. Estas podem relacionar-se com os conhecimentos substantivos que se apartam da abordagem preconizada por variadas razões (passados incómodos? temas difíceis? grupos não poderosos? …) ou com as competências de pensamento histórico (multiperspetiva, significância, causalidade, empatia, …) que parecem ter sido esquecidas quando se estruturou certo percurso de aprendizagem para estudantes com (...) idades entre os 6 e os 15 anos. Como considerações maiores, constata-se, naqueles textos curriculares (denominado Aprendizagens Essenciais), uma aparente simplificação genérica da narrativa histórica que se conta aos mais jovens cidadãos do mundo atual. A inevitável seleção de determinados saberes em detrimento de outros, na verdade, contribui, acima de tudo, para o escamotear de uma literacia histórica que podia, e devia, alcançar outros níveis. O processo de ensino (e de aprendizagem) da História, desde o começo da escolaridade obrigatória, tem de orientar-se no sentido de uma formação cidadã, esclarecida, democrática, intertemporal. As inexistências no que concerne aos conteúdos considerados ou ao raciocínio potenciado, por sua vez, somente comprometem aquele desígnio. (shrink)

La presente investigación tiene como objetivo demostrar la relación de la mejora del rendimiento académico y dominio de tres competencias digitales: manejo de información digital y comunicación en el entorno digital, colaboración y, creación del contenido digital al ser usados por el estudiante universitario en su proceso de aprendizaje activo, cómo codifican la información que aprenden, cómo comunican su desarrollo y cómo crean sus conocimientos para cumplir un propósito de mejora en sus notas y mejora académica.

The integration of nanotechnology’s ‘social and ethical issues’ (SEI) at the research and development stage is one of the defining features of nanotechnology governance in the United States. Mandated by law, integration extends the field of nanotechnology to include a role for the “social”, the “public” and the social sciences and humanities in research and development (R&D) practices and agendas. Drawing from interviews with scientists, engineers and policymakers who took part in an oral history of the “Future of Nanotechnology” symposium (...) at the Cornell NanoScale Facility, this article examines how nanotechnology’s ‘social and ethical issues’ are brought to life by these practitioners. From our analysis, three modes of enactment emerge: enacting SEI as obligations and problems-to-be-solved, enacting SEI by ‘not doing it’ in the laboratory, and enacting SEI as part of scientific practice. Together they paint a complex picture where SEI are variously defined, made visible or invisible, included and excluded, with participants showing their skill at both boundary-work (Gieryn Am Sociol Rev 48:781–795, 1983, 1999) and at integration. We conclude by reflecting on what this may mean for the design and implementation of SEI integration policies, suggesting that we need to transform SEI from obligations into ‘matters of care’ (Puig de la Bellacasa Soc Stud Sci 41(1):85–106, 2011) that tend to existing relationalities between science and society and implicate practitioners themselves. Resumen: Heidegger practica un abordaje de la noción de discurso que, por la magnitud de su obra y por el carácter más o menos marginal que esta noción tiene en ese conjunto, no ha merecido todavía un tratamiento sistemático. En esta comunicación intentamos recoger algunos elementos relevantes de esa tematización y enfatizamos la relación que ella manifiesta con su temprana concepción de la significación. Concluimos que la tematización del discurso que Heidegger desarrolla se adelanta en décadas a lo que es (...) hoy la teoría contemporánea del discurso.: Heidegger makes an approach to the notion of discourse which, to de magnitude of his work and the more or less marginal character that this notion has in that group, has not yet deserved systematic treatment. In this communication we try to collect some relevant elements of this thematization and emphasize the relationship that it manifests with its early conception of meaning. We concluded that the discourse thematization that Heidegger develops is decades ahead of what contemporary discourse theory is today. (shrink)

This article analyzes the treatment of natural philosophy in the work of Thomas Aquinas from the point of view of assimilation of the Aristotelian physical corpus. It focuses primarily on the Aquinas’s defense of the conception of the fallibility of the natural reason, the provisional and revisable character of all physical theories, the necessity of intercultural dialogue to discover the truths about nature, and Aquinas’s role in the development of the skeptical attitude in scientific research of the mobile’s world.

En el presente artículo se pretende hacer un recorrido por aquellas herramientas metodológicas utilizadas por Foucault para el estudio de la institución educativa disciplinaria y su posible aplicación al nuevo panorama educativo en las sociedades de control. Foucault analiza los discursos y prácticas como formas de poder en la sociedad disciplinaria, los cuales configuran una individualidad determinada: el cuerpo dócil.
